Starting July 1, a new law mandates that all bars and nightclubs must offer drug testing kits to patrons, ensuring their safety against dangerous date-rape drugs. Non-compliance could result in administrative actions against your license, so it's crucial to act now and protect your customers.

Starting July 1, a new law will require all establishments holding a Type 48 license to offer drug testing kits for sale or at no cost to patrons. This regulation, introduced by AB 1013 (Lowenthal), is designed to enhance patron safety by providing a means to detect common date-rape drugs, often referred to as ‘roofies.’
You must display a sign in a prominent and conspicuous location informing patrons that drug testing kits are available. The required signage must read: “Don’t get roofied! Drink spiking drug test kits available here. Ask a staff member for details.” A sample sign is available on the ABC website, which you can download and print.
As a Type 48 licensee, you are responsible for procuring these testing kits. The ABC does not sell or endorse any specific products, so you will need to source these from reliable suppliers. The kits can include test strips, stickers, straws, or other devices capable of detecting controlled substances such as flunitrazepam, ketamine, and gamma hydroxybutyric acid.
You must either offer these drug testing devices for sale to your patrons at a reasonable price based on the wholesale cost or provide them free of charge. Ensure that your staff is knowledgeable about the availability and use of these kits.
